Acheson Hotels, LLC.<\/a>, 50 F.4<sup>th<\/sup>&nbsp;259 (1<sup>st<\/sup>&nbsp;Cir. 2022). The Eleventh Circuit agrees,&nbsp;<a href=\"https:\/\/media.ca11.uscourts.gov\/opinions\/pub\/files\/202014846.pdf\" class=\"mtli_attachment mtli_pdf\">Laufer v. Arpan LLC<\/a>, 29 F.4<sup>th<\/sup>&nbsp;1268 (11<sup>th<\/sup>&nbsp;Cir. 2022), but the Second, Fifth, and Tenth Circuits disagree,&nbsp;<a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/USCOURTS-ca2-20-02672\/pdf\/USCOURTS-ca2-20-02672-0.pdf\" class=\"mtli_attachment mtli_pdf\">Harty v. W. Point Realty, Inc.<\/a>, 28 F.4<sup>th<\/sup>&nbsp;435 (2d Cir. 2022);&nbsp;<a href=\"https:\/\/www.ca5.uscourts.gov\/opinions\/pub\/20\/20-50858-CV0.pdf\" class=\"mtli_attachment mtli_pdf\">Laufer v. Mann Hospitality, Inc.<\/a>, 996 F.3d 269 (5<sup>th<\/sup>&nbsp;Cir. 2021);<a href=\"https:\/\/www.ca10.uscourts.gov\/sites\/ca10\/files\/opinions\/010110627575.pdf\" class=\"mtli_attachment mtli_pdf\">&nbsp;Laufer v.
